Statute of Limitations
The statute of limitations on a wrongful death or survival claim that arises from the wrongful act of another person or entity is generally three years in Washington. However, there are exceptions based on where the death occurred, how the death occurred, and the type of entity that caused the death. The statute of limitations may, in fact, be much shorter. There are also circumstances where notice must be provided to a person or entity that has wrongfully caused a loved one’s death in advance of being able to file a lawsuit. Thus, it is important to consult with an experienced attorney early in any potential case to ensure that you are aware of the actual statute of limitations and any notice that may be necessary.
